This website and online store are operated by Neil Galea, trading as Ferliy (“Ferliy”, “we”, “us” or “our”).

Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer products and services to you.

  1. THESE TERMS

These Terms of Service govern your access to our website and any purchases made from Ferliy.

By using our website or placing an order, you agree to these Terms, together with our Privacy Policy, Refund Policy and Shipping Policy. Nothing in these Terms limits any mandatory rights you have under Maltese or European Union consumer law.

If you do not agree to these Terms, you should not use our website or place an order.

  1. ONLINE STORE USE

You must use our website only for lawful purposes. You must not interfere with its operation, attempt to gain unauthorised access, introduce malicious software, misuse another person’s information or use the website in a fraudulent manner.

You are responsible for ensuring that any information you provide is accurate, complete and current.

  1. PRODUCTS

We make reasonable efforts to describe and display our products accurately. Colours and appearance may vary slightly depending on your screen, device settings and manufacturing variations.

Product photographs are illustrative. Minor differences that do not affect the product’s essential characteristics may occur.

Products and quantities are subject to availability. We may change or discontinue products, correct errors or limit quantities where reasonably necessary.

  1. PRICES AND ADDITIONAL CHARGES

Prices are displayed in euros unless stated otherwise. Taxes are included where required by applicable law.

Delivery charges and any other charges collected by Ferliy will be shown before you submit your order.

Some products may be dispatched from outside the European Union. Where import VAT, customs duties, clearance fees or carrier handling charges may be payable separately, this will be disclosed before you place your order where required by law. You will not be responsible for additional costs that applicable consumer law requires us to disclose but that were not disclosed before the order was placed.

  1. ORDERS AND CONTRACT FORMATION

When you submit an order, you make an offer to purchase the selected products.

An automatic acknowledgement confirms that we received your order; it does not necessarily mean that the order has been accepted. A binding contract is formed when we confirm acceptance of the order or begin fulfilling it.

We may reject or cancel an order for legitimate reasons, including product unavailability, an obvious pricing error, suspected fraud, payment failure or delivery restrictions. If payment has already been taken for a cancelled order, we will refund it using the original payment method.

Please check your order and delivery information carefully before submitting it. Contact us promptly if you notice an error.

  1. PAYMENT

Payment must be made using one of the payment methods available at checkout.

You confirm that you are authorised to use the selected payment method and that the billing information supplied is accurate. Payments may be processed by Shopify Payments, PayPal or another payment provider made available at checkout.

  1. DELIVERY

Available destinations, estimated delivery times and shipping charges are described in our Shipping Policy or displayed during checkout.

Delivery dates are estimates unless we expressly agree to a guaranteed date. We will inform you if we become aware of a material delay.

We remain responsible for the goods until they are delivered to you or to a person identified by you to receive them, except where you independently arrange a carrier that was not offered by us.

You are responsible for providing a complete and accurate delivery address. Please contact us immediately if you discover an error.

  1. CANCELLATIONS, RETURNS AND REFUNDS

Consumers generally have the right to withdraw from an online purchase within 14 days without giving a reason, subject to the exceptions permitted by law.

The withdrawal period generally begins on the day you, or a person nominated by you other than the carrier, receives the goods.

To exercise this right, contact us at ferliy.store@outlook.com with a clear statement that you wish to cancel. Include your name, order number and the product concerned.

Please do not return products to a supplier, manufacturer or the sender’s address. We will provide the correct return instructions and return address.

Further information, including return conditions, costs, exceptions and refund timing, is provided in our Refund Policy. That policy forms part of these Terms.

  1. FAULTY, DAMAGED OR INCORRECT PRODUCTS

Products must conform to the contract and meet the standards required by applicable consumer law.

If a product is faulty, damaged, incorrectly supplied or otherwise does not conform to the contract, contact us promptly at ferliy.store@outlook.com with your order number and supporting photographs where appropriate.

Your statutory rights, including any applicable legal guarantee of conformity and rights to repair, replacement, price reduction or refund, are not limited by these Terms or by any manufacturer’s warranty.

  1. ACCOUNTS

If you create an account, you are responsible for keeping your login details confidential and for activity conducted through your account.

Notify us promptly if you believe your account has been accessed without permission. We may suspend an account where reasonably necessary to protect you, other customers or our services.

  1. INTELLECTUAL PROPERTY

The content of this website, including the Ferliy name, branding, text, graphics and website design, is owned by or licensed to Ferliy and is protected by applicable intellectual-property laws.

You may use the website for personal, non-commercial shopping purposes. You may not reproduce, distribute, modify, sell or commercially exploit our content without prior written permission, except where permitted by law.

  1. REVIEWS AND FEEDBACK

If you submit a review or other content, you confirm that it is accurate, lawful and based on your genuine experience.

You give us a non-exclusive, worldwide, royalty-free licence to display, reproduce and adapt that content for operating and promoting Ferliy. You retain ownership of your content.

We may remove content that is unlawful, misleading, abusive, fraudulent or infringes another person’s rights.

  1. THIRD-PARTY SERVICES AND LINKS

Our website may contain links to, or integrations with, third-party services. Those services may have their own terms and privacy policies.

We are not responsible for third-party websites that we do not control. This does not affect our responsibility for performing our contract with you or for the actions of service providers acting on our behalf.

  1. SHOPIFY

Our store is hosted by Shopify. Purchases made through this store are made directly from Ferliy, not Shopify.

Shopify may process information and provide technical, payment and ecommerce services as explained in our Privacy Policy and Shopify’s applicable policies.

  1. PRIVACY

We process personal information in accordance with our Privacy Policy, which is available through the website footer.

Our Privacy Policy explains what information we collect, why we use it, who receives it and how you may exercise your data-protection rights.

  1. AVAILABILITY OF THE WEBSITE

We aim to keep the website available and secure, but uninterrupted or error-free access cannot be guaranteed.

We may temporarily restrict access for maintenance, security, updates or circumstances outside our reasonable control.

  1. LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or your mandatory consumer rights.

Subject to those rights, we are not liable for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a purchase made wholly for personal purposes.

  1. EVENTS OUTSIDE OUR CONTROL

We are not responsible for a delay or failure caused by circumstances outside our reasonable control. If such an event materially affects your order, we will contact you and take reasonable steps to minimise the delay.

Your statutory right to cancel where delivery cannot be completed within an agreed or legally required period remains unaffected.

We will try to acknowledge and resolve complaints within a reasonable time.

If we cannot resolve a consumer dispute directly, you may contact the Malta Competition and Consumer Affairs Authority or another competent consumer dispute-resolution body.

  1. CHANGES TO THESE TERMS

We may update these Terms to reflect legal, operational or service changes.

The version applying to an order is the version available when that order was placed. Material changes will not apply retrospectively to an existing order unless required by law or agreed with you.

  1. SEVERABILITY

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

  1. GOVERNING LAW

These Terms and contracts with Ferliy are governed by Maltese law.

If you are a consumer residing elsewhere in the European Union, you also retain the protection of any mandatory consumer laws applicable in your country of residence and any rights you have regarding where legal proceedings may be brought.
